AMALAN PENGURUSAN DAN SKOP BIDANGKUASA MUTAWALLI DI INSTITUSI PENDIDIKAN PONDOK DI KEDAH

Abstract

Mutawalli plays a significant role in the administration of waqf property. The role is either upon individual or institution that hold accountability in order to ensure the waqf property is administered in line with the shariah as well as the intention of waqf initiator towards beneficiaries. The mistake of appointing an unqualified mutawalli may result a misused of the property as his/her personal goods. The study was conducted on four pondok in Kedah, investigating the role that was played either from the perpective of primary mutawalli or of sub-mutawalli in ensuring the wakaf property is beneficial. The methodology of the study is using qualitatively method which involves content analysis. The study found that waqf document should be registered under MAIN which emphasized the intention of waqif. The appointment of sub-mutawalli should also be documented to ensure transparency as well as to explain the jurisdiction in sustaining the development of waqf property. In a meantime, there should have a third party to monitor shariah-compliant of the waqf asset. This is because there are aspects of wages, administrative expenses, purchasing and replacement of assets (istibdal) that related to the management of waqf property under mutawalli.
